The Bin Butler, LLC — Service Agreement (Chesapeake, VA)

• “Provider,” “we,” “us,” “our”: The Bin Butler, LLC.
• “Customer,” “you,” “your”: The person authorizing service and paying fees.
• “Service Address”: The residence specified at signup.
• “Bins”: Your trash and/or recycling carts.
• “Services”: Bin rolling to/from curb and any bin cleaning plan you select.2) Authorization & Access
You grant us a revocable license to access exterior areas of the Service Address (driveway, side yard, curb strip) on scheduled service days and reasonable surrounding windows to retrieve, roll, position, return, and (if applicable) clean your bins, including moving them to the public right-of-way and back. You agree to keep paths clear, secure pets, and provide accurate gate/entry codes.3) Service Area & Scope
• Service Area: Chesapeake, Virginia.
• Plans:
– Basic: Bin rolling service to and from curb.
– Standard: Basic + monthly bin cleaning.
– Premium: Basic + weekly bin cleaning (biweekly available on request).
We are independent and not affiliated with your hauler or the City.4) Scheduling & Windows
We service on your listed trash day or the day before/after. Arrival time varies by route and may be early morning or evening. Holiday or municipal changes may shift service. Missed municipal pickups due to these shifts are outside our control.5) Customer Responsibilities
• Provide safe, unobstructed access (no blocking vehicles/locks; secure pets).
• Keep lids closed; no loose sharps, hot ashes, paint, chemicals, explosives, or human/animal waste outside sealed bags.
• Update us promptly on gate codes, access changes, or day changes.
• Follow HOA/municipal rules for set-out/bring-in times (you’re responsible for any citations).If access is denied or unsafe, we may mark a visit “attempted”; credits/reschedules are at our discretion.6) Cleaning Practices
We use biodegradable cleaners and minimal water. Rinse water will be directed to lawn/landscaping where practicable; we avoid storm drains when reasonably possible. You consent to reasonable water use at your property or to our on-board supply, at our discretion.7) Photos & Communications
You consent to photos (e.g., placement and cleaning) for service marketing and support. We may send transactional emails or texts related to service.8) Fees, Billing & Term
• Month-to-month subscription billed in advance via our payment processor, Stripe.
• Auto-renewal until you cancel. Cancellation takes effect next billing cycle; no proration once a service window opens.
• Price/policy updates may occur with 14-day notice; continued service after notice = acceptance.
• Failed payments/chargebacks may result in pause or termination; you’re responsible for any processor/bank fees.9) Skips, Weather & Safety
We may delay/skip service for severe weather, unsafe conditions, blocked access, or hazardous contents. If we cause a miss, we’ll reschedule or credit at our discretion. No credit is due where access is denied/unsafe.10) Damage & Limitations
We are not responsible for:
• Pre-existing bin defects, normal wear/tear from rolling/handling on typical surfaces.
• Damage arising from hazardous, overloaded, or contaminated contents.
• Municipal/HOA citations based on rules outside our control.Limitation of Liability: To the fullest extent permitted by law, our total liability for any claim is limited to the amount you paid in the month before the event giving rise to the claim. This does not limit liability for gross negligence or willful misconduct.Indemnity: You agree to indemnify and hold us harmless from third-party claims arising from your breach of these Terms, hazardous contents you provide, or your failure to comply with HOA/municipal rules.11) Termination
Either party may terminate at any time. We may terminate or pause immediately for safety, non-payment, or misuse. Sections intended to survive (payments due, photos/records, limitations, and governing law) survive termination.12) Governing Law & Venue
These Terms are governed by Virginia law. Venue is Chesapeake, Virginia (including small claims court).13) Changes to Terms
We may update these Terms; we’ll post the new version and update the “Last Updated” date. Your continued use after notice means you accept the changes.15) Contact
